Judge Thy Neighbor

Docket #493 - 1162 votes cast

The Evidence

So I was in the NYC subway. I had enough money on my metrocard for one fare. When I swiped my card, it would not let me through. The screen read "please re-swipe" the first couple of times then said "insufficient funds". For those of you who use the subway regularly, you know the subway turnstiles do sometimes malfunction and when an official is watching the gate, they will usually just tell you to go through. There being no official around, I decided to jump the turnstile. Apparently there was a camera being watched by the NYPD, who stopped me 5 minutes later and gave me a $100 ticket. Did I do anything wrong?

He had other options. I've never ridden the subway, but I'm sure there are workers nearby to solve these kinds of situations.

Well, it was 2AM so, no, there was no workers watching the gate. I did look for someone first.

I've been through this crap too. Sucks, cause you're NOT guilty, but there's no real proof of that.

This happens all the time. If you had kept your card, they can check it's swipe history and see that you had paid. Problem is that you probably threw away the card because it was empty.

Couldnt you go to court and have them review the tape and see that you attempted to pay??
